В продаже на популярных классифайдах появилось большое количество машин с невероятно низким ценником. Приобретая такие автомобили, россияне могут сэкономить от нескольких сотен тысяч до миллиона и более рублей. Но и риски огромны. Autonews.ru побеседовал с юристами и узнал немало интересного.
Суть «дагестанской» схемы
Пытаясь сэкономить на покупке автомобилей, россияне часто обращают внимание на объявления, сулящие значительную финансовую выгоду. На этом и строится так называемая «дагестанская» схема.
Чаще всего эта схема практикуется в Южном федеральном округе и республиках Северного Кавказа — Чечне, Ингушетии и Дагестане. Жители республик размещают объявления о продаже машин с невероятно привлекательными ценниками. На первый взгляд, это беспроблемные, зачастую абсолютно новые автомобили: без повреждений, с хорошей комплектацией и приятным внешним видом. Однако все не настолько гладко, как может показаться.
Предлагаемые по привлекательным ценам автомобили оформлены на граждан Кыргызстана, чего не скрывают их продавцы. Сами автомобили продаются от лица родственников автовладельцев по генеральной доверенности с правом переоформления.
Заниженная стоимость машин объясняется продавцами низкими пошлинами, действующими в Киргизии. Покупатель такого автомобиля на киргизском учете может ездить по территории России до одного года, после чего придется выехать на машине из страны и заехать вновь, не забыв при этом переоформить генеральную доверенность от собственника на управление транспортным средством.
Чем рискуют покупатели
По словам юриста Льва Воропаева, покупку таких автомобилей полноценным приобретением транспортного средства считать нельзя изначально.
«Здесь слово «покупка» юридически неприменимо. Формально происходит не смена собственника транспортного средства, а лишь управление автомобилем на основании доверенности. То есть право собственности не переходит к новому приобретателю. Формально гражданин покупает право владения этим транспортным средством, то есть пользования, за фактическую стоимость автомобиля. Но с точки зрения обычного потребителя автомобиль покупается чуть ли не в два раза дешевле, чем он стоит в России. Ему кажется, что он экономит безумные деньги», — пояснил собеседник.
Подтвердил эту информацию и директор Ассоциации параллельного импорта Анатолий Семенов. Эксперт подчеркнул, что такая сделка — это никакая не покупка «по доверенности»: автомобиль фактически даже не становится собственностью покупателя.
Какие последствия грозят
По мнению экспертов, даже пользоваться такими транспортными средствами, приобретенными по доверенности по заниженной цене, в обозримой перспективе россияне вряд ли смогут.
Воропаев предупредил, что владение автомобилем, ввезенным в Россию из Армении, Абхазии и Казахстана показало, что подобные схемы работают до поры до времени. Фактически машины, растаможенные по более низким тарифам в Киргизии, не должны выезжать за ее пределы.
«Мы не знаем, какие размеры таможенных платежей были уплачены за эти автомобили в Киргизии. Если они были уплачены не по ставкам ЕАЭС, а по ставкам для внутреннего пользования, то этот товар является условно выпущенным на территории ЕАЭС и не является товаром ЕАЭС. Если начнется массовый ввоз, я так понимаю, все идет к этому, то государство даст команду, введет определенные нормативы, и эти автомобили начнут изымать на штрафстоянки, как это было с машинами на абхазских и армянских номерах. Водителей привлекали к ответственности за то, что они управляли этими автомобилями», — уточнил юрист.
В подтверждение своих слов эксперт напомнил, что таможенная служба уже начала по-своему трактовать уплату таможенных пошлин по казахским автомобилям. Это случилось спустя год после уплаты таможенных пошлин. С автовладельцев, которые ввозили автомобили из Казахстана, с 2024 года начали брать дополнительный утильсбор.
«Схема очень рисковая. Если граждане ради 600–700 тыс. руб., пусть даже 1,5 млн руб. готовы рискнуть своим автомобилем, и потом, даже потеряв этот автомобиль, не погасить перед государством те обязательные платежи, которые государство им выставит, в том числе в судебном порядке, то пожалуйста. Если все-таки они хотят спать спокойно, то я бы на их месте не рисковал», — заключил собеседник.
Специалист также напомнил историю с армянскими автомобилями, не зарегистрированными на территории России.
«Водителей начали привлекать за то, что они управляют автомобилями, не зарегистрированными в установленном порядке на территории России. Напомню, что за повторное привлечение предусмотрено лишение права управления транспортным средством. Кроме того, если таможенные пошлины не уплачены по средним ставкам ЕАЭС, будут налагать на такого гражданина обязанность уплатить таможенную разницу. Помимо этого также встанет вопрос и по уплате утилизационного сбора, потому что при ввозе автомобиля на территорию России, в том числе из стран ЕАЭС, необходимо уплачивать повышенный утилизационный сбор, даже если он был уплачен в стране ЕАЭС», — уточнил Воропаев.
Анатолий Семенов отметил, что в его практике есть кейс, когда за временный ввоз автомобиля гражданину доначислили более 20 млн руб.
«В принципе такой риск есть, поскольку таможня взыскивает его даже за временно ввезенные транспортные средства — у меня сейчас в работе одно такое дело. Тут, по сути, тоже выглядит как временный ввоз, так что риски вполне реальные», — пояснил эксперт.
К слову, недавно на машины из Армении стали массово доначислять утильсбор. Суммы, которые требует доплатить ФТС, могут кратно превышать стоимость самих машин. Попытка россиян сэкономить обернулась для многих дополнительными тратами в сотни тысяч и миллионы рублей.
